Terms of Service

These Terms of Service (“Terms”) govern your use of the ARIS application, website, and related services (collectively, the “Service”) provided by ARIS (“we,” “us,” or “our”). By using the Service, you agree to these Terms.

By downloading, installing, or using ARIS, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

ARIS is an astrophotography equipment control application that allows you to operate imaging hardware (mounts, cameras, focusers, guiders, and accessories) via a mobile or web interface. The app connects to backend servers running INDI drivers on your local network.

ARIS is currently in beta (v0.1.0). The Service is provided on an as-is basis and may contain bugs, incomplete features, or instability. We actively work to improve the Service but cannot guarantee uninterrupted or error-free operation during the beta period.

You may use ARIS with an anonymous (guest) account or create a full account using Google Sign-In, Apple Sign-In, or email/password. You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

You agree to use the Service only for its intended purpose of controlling astrophotography equipment. You agree not to:

  • Reverse engineer, decompile, or disassemble the application.
  • Use the Service to interfere with or disrupt other users or systems.
  • Attempt to gain unauthorized access to systems or networks connected through the Service.
  • Use the Service in any manner that violates applicable laws or regulations.
  • Redistribute, sublicense, or resell the Service.

This section is critically important. Please read it carefully.

ARIS sends commands to physical equipment including motorized telescope mounts, electronic cameras, and powered accessories. Improper use can result in equipment damage or personal injury.

  • You are solely responsible for the safe operation of your equipment.
  • Always verify that your equipment is properly set up, balanced, and within its operational limits before issuing commands through ARIS.
  • Motorized mounts can move with significant force. Ensure that cables are routed to avoid snags, that the telescope can move freely without obstruction, and that no persons are in the path of movement.
  • Never leave equipment unattended during initial setup and testing with ARIS. Automated sequences should only be run unattended after you have verified correct operation.
  • Power management commands can turn equipment on and off. Verify power box configurations carefully before enabling remote power control.
  • ARIS is not a safety system. The app does not have physical awareness of your equipment state and cannot detect obstructions, cable snags, balance issues, or environmental hazards.

We are not responsible for any damage to equipment, property, or persons arising from use of the Service.

ARIS is currently in beta. By using the beta version, you acknowledge that:

  • The software may contain bugs, errors, and incomplete features.
  • Features may change, be removed, or behave unexpectedly between updates.
  • Data loss is possible, though we take reasonable steps to prevent it.
  • The beta period and free access may end with reasonable notice.
  • Beta feedback you provide may be used to improve the Service.

The ARIS application, including its code, design, documentation, and branding, is the intellectual property of ARIS and its creators. These Terms do not grant you any ownership rights to the Service.

Your data (equipment profiles, account information, captured images) remains your property. We claim no ownership over your data.

ARIS integrates with third-party services including Firebase (Google), Sentry, and Cloudflare. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the operation or availability of third-party services.

ARIS connects to INDI drivers and servers that are open-source software maintained by independent developers. We are not responsible for bugs or issues in INDI drivers.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your specific requirements.
  • The Service will be uninterrupted, timely, secure, or error-free.
  • Results obtained from the Service will be accurate or reliable.
  • Any errors in the Service will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARIS, ITS CREATORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service.
  • Any damage to your equipment, property, or person arising from use of the Service.
  • Unauthorized access to or alteration of your data.
  • Any third-party conduct related to the Service.
  • Any other matter relating to the Service.

You agree to indemnify and hold harmless ARIS and its creators from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or your violation of these Terms.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time.

Upon termination:

  • Your right to use the Service ceases immediately.
  • You may request deletion of your account data by contacting us.
  • Provisions of these Terms that by their nature should survive termination will survive (including disclaimers, limitations of liability, and indemnification).

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or on our website and updating the “Last updated” date above. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

If you do not agree with updated Terms, you should stop using the Service.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ARIS regarding your use of the Service.
